Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs everyone's use of Molokai Cellular and is incorporated into the Terms of Service. The goal is simple: keep our network reliable, lawful, and respectful of others.

1. Prohibited uses

1.1 Illegal activity

You may not use the Service to commit, facilitate, or encourage any violation of law. This includes (but is not limited to) fraud, harassment, threats, theft, intellectual-property infringement, child sexual abuse material (CSAM) — which we will report to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A — and any activity prohibited by the FCC, FTC, or Hawaii law.

1.2 Spam, robocalls, and bulk SMS

You may not use the Service to send unsolicited commercial messages, conduct automated dialing without prior express consent in violation of the Telephone Consumer Protection Act (TCPA) or CAN-SPAM Act, deploy SMS spam, or originate calls that violate STIR/SHAKEN signing or caller-ID authenticity rules.

1.3 Network abuse

  • No resale or sublicensing of the Service to third parties without our prior written agreement.
  • No operation of public proxy or VPN exit nodes.
  • No SIM-box, GSM-gateway, or grey-route termination of voice traffic.
  • No tethering or hotspot use in excess of the high-speed data cap on your plan; we may de-prioritize traffic beyond the cap or enforce the cap technically.
  • No use of the Service in a way that materially degrades performance for other customers.

1.4 Fraud and impersonation

You may not impersonate any person or entity, spoof caller ID in a manner that violates the Truth in Caller ID Act, conduct phishing or vishing, or commit subscription fraud against us or our carrier partners.

1.5 Security violations

No attempts to gain unauthorized access to any system, scan or probe networks without authorization, deploy malware or denial-of-service attacks, or interfere with other customers' service.

2. Fair-use data thresholds

Plans include a stated high-speed data allowance per billing cycle. Once you exceed that allowance, speeds may be reduced to 128 kbps or lower for the remainder of the billing cycle. This is consistent with standard MVNO practice and is independent of any de-prioritization that the underlying carrier may apply during congestion.

3. Reporting abuse

If you believe someone is abusing the Service, report it to [email protected]. We investigate every report. We disclose to law enforcement only under valid legal process or where required by law.

4. DMCA — copyright infringement

If you believe content stored or transmitted via the Service infringes your copyright, send a DMCA notice under 17 U.S.C. § 512(c)(3) to our designated agent:

Counter-notices may be sent to the same address. We will follow the procedures in § 512(g). Repeat infringers will have accounts terminated in accordance with our policy.

5. Enforcement

We may suspend or terminate accounts for violations of this AUP. For serious violations (illegal activity, security threats, fraud, network abuse causing real-time harm) we may suspend the account immediately without prior notice. For all other violations we generally provide notice and an opportunity to cure.

6. Changes

We may update this AUP from time to time. Material changes will be announced by email and posted here.
